Uygulanabilir yaşın altındaki hiçbir kişinin Hizmeti kullanmasına veya bu tür bir kişiden kişisel veri toplanmasına bilerek izin vermiyoruz. Uygulanabilir yaşın altındaki bir kişinin Hizmete eriştiğini düşünen bir ebeveyn veya yasal vasi   support@forgezero.com  ile iletişime geçebilir; söz konusu erişimi sona erdirmek için makul adımları atacağız.   BÖLÜM II: KULLANIM KOŞULLARI VE SORUMLULUK SINIRLAMALARI  Bu Bölüm II, Uygulamayı kullanımınızı düzenler ve Şirket, Fikret Anıl Haksever, Forge Zero ve bunların iştirakleri, lisans verenleri, yüklenicileri, temsilcileri, yetkilileri ve temsilcileri (topluca \"  Korunan Taraflar \") için uygulanabilir hukuk çerçevesinde izin verilen en geniş sorumluluk korumasını sağlar.  1. Uygunluk ve Kullanıcı Beyanları  Hizmeti kullanarak aşağıdaki hususları beyan ve taahhüt edersiniz:   Yargı yetkinizdeki yasal reşitlik yaşına ulaşmış olduğunuzu ve bağlayıcı bir sözleşme yapmak için tam yasal ehliyete sahip olduğunuzu;  Türkiye Cumhuriyeti, ABD, Birleşik Krallık veya AB tarafından ambargo uygulanan hiçbir ülkede bulunmadığınızı, bu ülkelerin kontrolü altında olmadığınızı veya vatandaşı olmadığınızı ve herhangi bir devlet kısıtlı taraflar listesinde yer almadığınızı;  Hizmeti yalnızca yasal amaçlarla ve işbu Sözleşme ile tüm uygulanabilir yasalara uygun olarak kullanacağınızı.  2. Hizmetin Niteliği  Scorebuddy, algoritmik ve olasılıksal Makine Öğrenimi (\"  ML \") modelleri tarafından üretilen tarihsel futbol istatistikleri ve çıktılar sunar. Hizmet, kesinlikle   yalnızca bilgilendirme, eğitim ve eğlence amaçlı  olarak sağlanır. Hizmet, hiçbir türde — finansal, hukuki, yatırım veya başka — profesyonel tavsiye   değildir  ve bu şekilde kullanılmamalıdır.  3. Abonelikler, Faturalandırma ve İade Yapılmama Politikası  Hizmetin bazı premium özellikleri, otomatik yenilenen abonelik veya tek seferlik uygulama içi satın alma (topluca \"  Ücretli Hizmetler \") bazında sunulabilir. Tüm Ücretli Hizmetleri aşağıdaki koşullar düzenler:    Platform Faturalandırması.  Ücretli Hizmetlere ilişkin tüm işlemler, Uygulamayı edindiğiniz uygulama mağazası platformu tarafından — Apple App Store (Apple Media Services aracılığıyla) veya Google Play Store (Google Play Billing aracılığıyla) —   münhasıran  işlenir. Şirket ödeme kartı veya banka bilgilerinizi toplamaz, işlemez, saklamaz veya bunlara erişemez. Faturalandırma ilişkiniz yalnızca ilgili platform operatörüyle olup, o operatörün ödeme şartları, faturalandırma politikaları ve iade prosedürlerine tabidir.   Otomatik Yenileme.  Abonelikler, yenileme tarihinden önce iptal edilmedikçe, o tarihteki fiyat üzerinden eşit süreli ardışık dönemler için otomatik olarak yenilenir. Apple veya Google'ı, her yenilemede ödeme yönteminizden tahsilat yapma konusunda yetkilendirirsiniz.   İptal.  Otomatik yenilenen aboneliğinizi istediğiniz zaman Apple ID hesap ayarlarınızdan (iOS kullanıcıları için) veya Google Play hesap ayarlarınızdan (Android kullanıcıları için) iptal edebilirsiniz. Bir sonraki dönem için ücretlendirilmemeniz adına, iptal işlemleri mevcut fatura döngüsünün bitmesinden   en az yirmi dört (24) saat önce  tamamlanmalıdır. Şirket sizin adınıza aboneliğinizi iptal edemez.   Fiyat Değişiklikleri.  Şirket, Ücretli Hizmetlerin fiyatını istediği zaman değiştirebilir. Aboneliğinize uygulanacak fiyat değişiklikleri ilgili platform üzerinden bildirilir ve yalnızca uygulanabilir platform kuralları ve tüketici hukuku çerçevesindeki bildirim ve onay şartlarına tabi olmak üzere, izleyen fatura dönemlerinde yürürlüğe girer.   İade Yapılmama Politikası.  Uygulanabilir hukukun izin verdiği azami ölçüde, Ücretli Hizmetler için yapılan tüm ödemeler   iade edilmez . Şirket; (i) kısmi abonelik dönemleri, (ii) kullanılmayan özellikler, (iii) analitik çıktılardan memnuniyetsizlik, (iv) herhangi bir ML tahmininin olasılıksal başarısızlığı, hatalılığı veya gerçekleşmemesi (bu bir kusur olmayıp Bölüm 5'te açıkça feragat edilmiştir), (v) Yukarı Akış Kaynağı (Bölüm 6'da tanımlandığı şekilde) arızaları, (vi) yenileme öncesi iptal yapamamanız veya (vii) zorunlu tüketici hukukunun gerektirdiği haller dışında herhangi bir neden için iade, kredi veya orantılı düzeltme yapmayacaktır.   Zorunlu Tüketici Hakları.  Bununla birlikte, uygulanabilir zorunlu tüketici koruma hukuku size iade veya cayma hakkını — 6502 sayılı Tüketicinin Korunması Hakkında Kanun kapsamındaki Mesafeli Sözleşmeler Yönetmeliği uyarınca on dört (14) günlük cayma hakkı ve AB Tüketici Hakları Direktifi 2011/83/EU'nun 9-16. maddeleri dahil — devredilemez şekilde tanıyorsa, bu haklar kanunun gerektirdiği ölçüde size uygulanır. Ancak,   cayma süresinin dolmasından önce dijital içeriğin derhal sunulmasına açıkça rıza göstermiş ve cayma hakkınızı kaybedeceğinizi açıkça kabul etmiş olmanız  (söz konusu kanunlar ve Apple/Google platform koşullarınca izin verildiği üzere) halinde, cayma hakkından söz konusu dijital içerik bakımından kanunun izin verdiği azami ölçüde feragat etmiş sayılırsınız.   Platform İadeleri.  İade talepleri her durumda Apple'a (  https://support.apple.com/HT204084 ) veya Google'a (  https://support.google.com/googleplay/answer/2479637 ) ilgili iade politikaları uyarınca iletilebilir; bu politikalar işbu Sözleşmeden bağımsız olarak uygulanır. Apple veya Google size bir iade yaptığında Şirketin bu iadeyi tekrarlama yükümlülüğü yoktur.  4. Bahis, Şans Oyunları ve Kumara Kesin Yasak   Scorebuddy; bir spor bahis, kumar, piyango, şans oyunu veya finansal danışmanlık aracı değildir ve bu amaçla kullanılmamalıdır.    Türk Hukukuna Uygunluk:  Türkiye Cumhuriyeti, izinsiz spor bahislerini, müşterek bahis ve şans oyunlarını (sınırlama olmaksızın)   7258 sayılı Kanun  (  Futbol ve Diğer Spor Müsabakalarında Bahis ve Şans Oyunları Düzenlenmesi Hakkında Kanun ), Türk Ceza Kanunu (5237 sayılı Kanun) ve   5651 sayılı Kanun  (İnternet Ortamında Yapılan Yayınların Düzenlenmesi ve Bu Yayınlar Yoluyla İşlenen Suçlarla Mücadele Edilmesi Hakkında Kanun) çerçevesinde sıkı şekilde düzenlemekte ve/veya yasaklamaktadır. Türkiye'de yalnızca yetkili Türk makamları (kendi alanlarında   Spor Toto Teşkilat Başkanlığı  ve   Türkiye Jokey Kulübü ) tarafından lisans verilen operatörler spor bahsi sunabilir. Hizmet böyle bir lisanslı operatör değildir ve bahis sunmaz, kolaylaştırmaz, aracılık etmez veya tanıtmaz.   Kötüye Kullanım Niteliği:  Hizmetin istatistiklerinin, çıktılarının, öngörülerinin, tahminlerinin veya diğer herhangi bir içeriğinin; gerçek para veya değer karşılığı spor bahisleri, müşterek bahis veya kumar oynamak, bilgilendirmek, kolaylaştırmak, aracılık etmek, tanıtmak veya icra etmek için kullanımı kesinlikle yasaktır ve — Kullanıcının yargı yetkisinde böyle bir faaliyetin hukuki statüsünden bağımsız olarak — işbu Sözleşmenin   esaslı bir ihlalini  teşkil eder.   Risk Üstlenimi:  Spor sonuçları doğası gereği öngörülemezdir. Hizmete dayanarak veya Hizmet ile bağlantılı olarak gerçekleştirdiğiniz herhangi bir karar veya eylem için tüm risk, maliyet, kayıp ve sonuçların yüzde yüzünü (%100) üstlendiğinizi kabul ve beyan edersiniz.   Yerel Hukuka Uygunluk:  Hizmeti kullanımınızın spor istatistikleri, tahmin hizmetleri, kumar ve veri koruma ile ilgili yargı yetkinizdeki tüm yasalar dahil olmak üzere size uygulanabilir tüm yasalara uygun olmasını sağlamaktan yalnızca siz sorumlusunuz.  5. Makine Öğrenimi ve \"Olduğu Gibi\" Sorumluluk Reddi  Scorebuddy tarafından kullanılan istatistiksel modeller ve ML algoritmaları deneysel, olasılıksal ve deterministik olmayan niteliktedir.    Doğruluk Garantisi Yoktur:  Şirket, Hizmetin herhangi bir çıktısının doğruluğu, eksiksizliği, güvenilirliği, zamanlaması, güncelliği veya uygunluğu konusunda   hiçbir  beyan, garanti veya taahhütte bulunmamaktadır.   Tüm Garantilerin Reddi:  Uygulanabilir hukukun izin verdiği azami ölçüde, Hizmet, tüm içerik ve tüm çıktılar \"  OLDUĞU GİBİ \" ve \"  MEVCUT OLDUĞU ŞEKİLDE \",   tüm kusurlarıyla  ve   hiçbir türde garanti verilmeksizin  sunulmaktadır. Korunan Taraflar; açık, zımni, yasal veya ticari teamülden kaynaklanan tüm garantileri, özellikle ticarete elverişlilik, belirli bir amaca uygunluk, doğruluk, mülkiyet, ihlal etmeme ve sessiz kullanım zımni garantileri dahil reddeder.   Tavsiye Değildir:  Hizmetteki hiçbir şey profesyonel, finansal, hukuki, tıbbi veya yatırım tavsiyesi teşkil etmez.  6. Hizmet Erişilebilirliği ve Yukarı Akış Veri Bağımlılığı  Hizmet; Şirketin sahip olmadığı veya kontrol etmediği bağımsız üçüncü taraf spor veri sağlayıcıları, kamu depoları, özgür ve açık kaynak yazılımlar ve diğer üst kaynaklar (topluca \"  Yukarı Akış Kaynakları \") üzerindeki sürekli veri beslemelerine dayanılarak oluşturulmuştur. Aşağıdaki hususları açıkça kabul eder ve onaylarsınız:    Erişilebilirlik Garantisi Yoktur.  Şirket; Hizmetin, herhangi bir özelliğinin veya herhangi bir analitik çıktının herhangi bir anda erişilebilir, kesintisiz, zamanında, güvenli veya hatasız olacağına dair hiçbir beyan, garanti veya taahhütte bulunmamaktadır. Hizmet yalnızca makul çaba esasına göre sağlanır.   Yukarı Akış Değişkenliği.  Şirket; Hizmetin veya herhangi bir parçasının, herhangi bir Yukarı Akış Kaynağının veya üçüncü taraf platformun (Apple ve Google dahil) arızası, değişikliği, kesintisi, hız sınırlaması, erişim iptali, fiyat değişikliği, lisans değişikliği, yeniden yapılanması, devralınması, kapatılması veya başka herhangi bir eylemi ya da ihmalinden kaynaklanan bozulma, gecikme, yanlışlık, askıya alma, sınırlama veya sonlandırmadan sorumlu olmayacaktır. Yukarı Akış Kaynakları bağımsız üçüncü taraflardır ve eylemleri Şirketin makul kontrolü dışındadır.   Değiştirme, Askıya Alma veya Sona Erdirme Hakkı.  Şirket; Hizmeti (veya herhangi bir özelliği, analitik çıktıyı, ligi, yarışmayı, bölgeyi veya entegrasyonu) herhangi bir zamanda kendi takdirine bağlı olarak, bildirimli veya bildirimsiz, geçici veya kalıcı olarak ve size veya herhangi bir üçüncü tarafa sorumluluk olmaksızın değiştirme, askıya alma, sınırlama veya sona erdirme hakkını saklı tutar. Ücretli Hizmetler için ön ödeme yapmış olmanız ve Şirketin Hizmetin tümünü kalıcı olarak sonlandırması halinde Şirket, uygulanabilir zorunlu tüketici hukukunun veya platform politikasının gerektirdiği ölçüde orantılı iadelerin kolaylaştırılması için Apple veya Google ile işbirliği yapacaktır.   Planlı ve Plansız Kesintiler.  Hizmet, bakım, güncelleme veya güvenlik olaylarına yanıt sırasında erişilemez olabilir. Bu tür kesintiler Sözleşmenin ihlali sayılmaz.  7. Kullanıcı Yükümlülükleri  Aşağıdakileri yapmayacak ve bir üçüncü tarafa yaptırmayacaksınız:   Hizmeti yasa dışı bir amaçla veya işbu Sözleşmenin ihlali suretiyle kullanmak;  Uygulanabilir hukukun yasakladığı ölçü dışında, Hizmetin kaynak kodunu, modellerini, ağırlıklarını veya temel algoritmalarını tersine mühendislikle ortaya çıkarmak, kaynak koduna dönüştürmek, ayrıştırmak, kurcalamak veya bunları türetmeye çalışmak;  Hizmetten veri kazımak, toplamak veya toplu çıkarım yapmak;  Hizmete veya ilgili sistemlere müdahale etmek, bunları kesintiye uğratmak veya bunlara yetkisiz erişim sağlamaya çalışmak;  Hizmete zarar verecek, devre dışı bırakacak, aşırı yükleyecek veya bozacak şekilde kullanmak;  Hizmeti Bölüm 4'te daha ayrıntılı açıklanan herhangi bir bahis, kumar veya müşterek bahis faaliyetiyle bağlantılı olarak kullanmak;   Otomatik Erişim ve Çıktı Hasadı.  Hizmete Şirket tarafından sağlanan normal kullanıcı arayüzü dışında erişmek veya kullanmak, Hizmetin herhangi bir tahmin çıktısını, istatistiğini, veri kümesini veya model yanıtını çıkarmak, kopyalamak, bir araya getirmek, yeniden yayınlamak, paraya çevirmek veya yeniden satmak, ya da Hizmetin çıktılarından rakip bir model, veri kümesi veya hizmet yeniden oluşturmak, çoğaltmak, eğitmek, ince ayar yapmak veya damıtmak amacıyla herhangi bir robot, örümcek, tarayıcı, kazıyıcı, otomatik betik, başsız tarayıcı, yapay zeka ajanı, yetkisiz uygulama veya başka bir otomatik ya da manuel araç kullanmak. Bu hükmün ihlali işbu Sözleşmenin   esaslı ihlalini  teşkil eder. Kanun veya hakkaniyet çerçevesindeki diğer tüm yollara ek olarak Şirket; kendi takdirine bağlı olarak ve daha fazla bildirimde bulunmaksızın Hizmete erişiminizi derhal askıya alma veya sona erdirme ve ihlali yapan cihazı, hesabı, IP adresini veya diğer tanımlayıcıyı kalıcı olarak engelleme hakkını saklı tutar.   İhlali yapan Kullanıcının herhangi bir ticari, mesleki, zanaat veya ticari faaliyet kapsamı dışında hareket eden bir gerçek kişi tüketici olması halinde, yukarıdaki askıya alma ve engelleme Şirketin bu madde kapsamındaki tek çözüm yoludur ve bu madde gerekçesiyle hiçbir ön ödenmiş ücret alıkonulmaz.  İhlali yapan Kullanıcının böyle bir tüketici olmaması halinde — özellikle ticari, rekabetçi, kazıma, toplama, model eğitimi, damıtma veya yeniden satış amaçlarıyla hareket eden kişi veya kuruluşlar dahil — Şirket ayrıca ön ödenmiş ücretleri, tarafların çıktı hırsızlığının zarar tespitindeki güçlükler sebebiyle zararın makul bir ön tahmini olarak kabul ettiği   cezai şart  niteliğinde alıkoyma hakkını saklı tutar. Türk Borçlar Kanunu'nun 182. maddesinin veya eşdeğer herhangi bir kanunun yetkili bir mahkemeye aşırı bulduğu cezai veya tazminat şartını azaltma yetkisi tanıdığı hallerde, bu indirim tek çözüm olacak ve bu Bölümün kalanı tam olarak yürürlükte kalmaya devam edecektir.  8. Sorumluluğun Sınırlandırılması  UYGULANABİLİR HUKUKUN İZİN VERDİĞİ AZAMİ ÖLÇÜDE, KORUNAN TARAFLARDAN HİÇBİRİ SİZE VEYA HERHANGİ BİR ÜÇÜNCÜ TARAFA KARŞI AŞAĞIDAKİLER DAHİL DOLAYLI, ARIZİ, ÖZEL, MİSAL TEŞKİL EDEN, MÜTESELSİL VEYA CEZAİ ZARARLARDAN SORUMLU OLMAYACAKTIR:   Finansal kayıplar, kâr kayıpları, gelir kayıpları, kumar kayıpları veya herhangi bir dayanakla doğmuş borçlar;  Veri kaybı, kullanım kaybı, itibar kaybı veya diğer maddi olmayan kayıplar;  İçerik, çıktı veya tahminlerdeki hatalar, yanlışlıklar, eksiklikler veya kusurlar;  Cihazınıza veya verilerinize yetkisiz erişim veya bunların değiştirilmesi;  Hizmetteki herhangi bir üçüncü taraf davranışı veya içeriği.  Korunan Tarafların işbu Sözleşmeden veya Hizmetten kaynaklanan ya da bunlarla ilgili tüm taleplere ilişkin toplam kümülatif sorumlulukları; (a) iddiaya yol açan olaydan önceki on iki (12) ayda Hizmet için doğrudan Şirkete ödemiş olduğunuz toplam tutar veya (b) yirmi beş Türk Lirası (₺25) tutarlarından büyük olanını aşmayacaktır.  Bu sınırlama; iddia edilen sorumluluğun sözleşme, haksız fiil (ihmal dahil), kusursuz sorumluluk, kanun veya başka bir temele dayanmasına bakılmaksızın ve Korunan Taraflardan biri bu tür zararlara uğrama olasılığı hakkında uyarılmış olsa bile uygulanır.  İşbu Sözleşmedeki hiçbir hüküm, herhangi bir Korunan Tarafın; (i) dolandırıcılık veya dolandırıcı beyan; (ii) ağır ihmal veya kasıt; (iii) ihmal sonucu ölüm veya kişisel yaralanma; veya (iv) uygulanabilir zorunlu hukuk (6502 sayılı Türk Tüketicinin Korunması Hakkında Kanun ve 93/13/EEC sayılı AB Haksız Sözleşme Şartları Direktifi dahil) kapsamında hariç tutulamayan veya sınırlandırılamayan başka bir sorumluluktan kaynaklanan sorumluluğunu hariç tutmaz veya sınırlandırmaz. Bu Bölüm, Korunan Taraflara uygulanabilir hukukun izin verdiği azami korumayı sağlayacak şekilde yorumlanacaktır.  9. Tazminat  Uygulanabilir hukukun izin verdiği azami ölçüde; Hizmete erişiminiz veya kullanımınızdan, işbu Sözleşmenin herhangi bir hükmünü (özellikle Bölüm 4'teki bahis ve müşterek bahis yasağı dahil) ihlal etmenizden veya uygulanabilir herhangi bir hukuku ya da üçüncü taraf hakkını ihlal etmenizden kaynaklanan veya bunlarla ilgili tüm talepler, davalar, istemler, zararlar, kararlar, sorumluluklar, kayıplar, maliyetler ve masraflara (makul avukatlık ücretleri ve mahkeme masrafları dahil) karşı Korunan Tarafları savunmayı, tazmin etmeyi ve zarar görmemelerini sağlamayı kabul edersiniz.  Bu Bölüm yalnızca yargı yetkinizdeki zorunlu tüketici koruma hukukunun izin verdiği ölçüde uygulanır; uygulanabilir zorunlu tüketici hukukunun tüketicilerden tazminatı sınırlandırdığı hallerde, bu Bölüm yalnızca izin verilen ölçüde uygulanır ve Sözleşmenin geri kalanı tam olarak yürürlükte kalmaya devam eder.  10. Uygulanacak Hukuk ve Yargı Yetkisi  İşbu Sözleşme, kanunlar ihtilafı hükümleri dikkate alınmaksızın   Türkiye Cumhuriyeti  yasalarına tabidir ve bu yasalara göre yorumlanır. Birleşmiş Milletler Milletlerarası Mal Satışına İlişkin Sözleşmeler Hakkında Konvansiyonu uygulanmaz.  İşbu Sözleşmeden veya Hizmetten kaynaklanan her türlü uyuşmazlık, anlaşmazlık veya talep yalnızca   Büyükçekmece, İstanbul, Türkiye 'deki yetkili mahkemeler ve icra daireleri önünde görülecek olup taraflar kişisel yargı yetkisi ve mahkeme yerine gayrikabili rücu olarak tabi olduklarını beyan ederler.  Yukarıdakilere bakılmaksızın; Türkiye, Avrupa Birliği, Birleşik Krallık veya zorunlu tüketici koruma hukuku size yerel mahkemelerinizde yargılama hakkı veya zorunlu yerel korumalardan yararlanma hakkı tanıyan başka bir yargı yetkisinde mukim tüketici iseniz bu haklar size uygulanmaya devam edecek ve işbu Sözleşmenin hiçbir hükmü sizi bu haklardan yoksun bırakacak şekilde yorumlanmayacaktır. Türk tüketici uyuşmazlıkları, uygulanabilir parasal sınırlar içerisinde, kanunen gerekli olduğunda yetkili   Tüketici Hakem Heyeti  veya   Tüketici Mahkemesi  önünde görülebilir.  11. Apple App Store EULA Hükümleri  Uygulamayı Apple App Store'dan edindiyseniz, Apple Inc. (\"Apple\") tarafından gerekli kılınan aşağıdaki ek koşullar geçerlidir:    Kabul.  İşbu Sözleşme yalnızca siz ve Şirket arasında akdedilmiş olup Apple ile akdedilmemiştir. Uygulamadan ve içeriğinden yalnızca Şirket (Apple değil) sorumludur.   Lisansın Kapsamı.  Uygulama için size verilen lisans; Apple Media Services Şartları ve Koşullarında belirtilen Apple Kullanım Kurallarına izin verdiği ölçüde, sahip olduğunuz veya kontrol ettiğiniz herhangi bir Apple markalı üründe Uygulamayı kullanmak için devredilemez bir lisansla sınırlıdır.   Bakım ve Destek.  Uygulamaya ilişkin her türlü bakım ve destek hizmetinden yalnızca Şirket sorumludur. Apple'ın Uygulamaya ilişkin herhangi bir bakım veya destek hizmeti sağlama yükümlülüğü bulunmamaktadır.   Garanti.  Uygulanabilir zorunlu tüketici hukukunun izin verdiği ölçüde — Avrupa Ekonomik Alanı ve Birleşik Krallık'taki tüketicilerin sözleşmeyle hariç tutulamayan yasal hakları dahil — hukukun etkin biçimde feragat edilemediği ölçüde, açık veya zımni her türlü ürün garantisinden yalnızca Şirket sorumludur. Uygulamanın herhangi bir geçerli garantiyi karşılamaması halinde Apple'a haber verebilirsiniz ve Apple, Uygulama için ödenen fiyatı (varsa) iade edecektir; uygulanabilir hukukun izin verdiği azami ölçüde, Apple'ın Uygulamaya ilişkin başka hiçbir garanti yükümlülüğü bulunmamakta olup herhangi bir garantiye uyulmamasından kaynaklanan diğer tüm talepler, kayıplar, yükümlülükler, zararlar, maliyetler veya masraflar yalnızca Şirketin sorumluluğundadır.   Ürün Talepleri. Fikri Mülkiyet Hakları.  Uygulamanın veya sizin Uygulamayı zilyetliğinizde bulundurmanız ya da kullanımınızın söz konusu üçüncü tarafın fikri mülkiyet haklarını ihlal ettiğine dair herhangi bir üçüncü taraf talebi halinde, bu ihlal talebinin soruşturulması, savunulması, uzlaşmaya varılması ve ifasından yalnızca Şirket (Apple değil) sorumlu olacaktır.   Hukuki Uyum. Üçüncü Kişi Lehdar. Google Play Store Hükümleri  Uygulamayı Google Play'den edindiyseniz, Uygulamayı kullanımınızın ayrıca Google Play Hizmet Şartlarına tabi olduğunu ve Google LLC (\"Google\") ve iştiraklerinin işbu Sözleşmenin üçüncü kişi lehdarları olduğunu ve bunu size karşı uygulayabileceklerini kabul edersiniz. Uygulamadan ve içeriğinden yalnızca Şirket sorumludur; Google değildir. Google'ın platform düzeyindeki veri uygulamaları, Bölüm I, 3. Kısımda açıklandığı şekilde Google'ın kendi gizlilik politikasına tabidir.  13. Fikri Mülkiyet  Hizmete ilişkin tüm içerik, yazılım, modeller, algoritmalar, ticari markalar, logolar ve ilgili fikri mülkiyet dahil olmak üzere tüm haklar, ünvanlar ve menfaatler Şirketin ve lisans verenlerinin münhasır mülkiyetinde kalacaktır. Uygulamayı sahip olduğunuz veya kontrol ettiğiniz bir cihazda kişisel, ticari olmayan kullanımınız için kısıtlı, kişisel, iptal edilebilir, münhasır olmayan, devredilemez lisans dışında, işbu Sözleşme kapsamında size hiçbir hak verilmemektedir.  14. Üçüncü Taraf Spor Verileri, Markalar ve Fikri Mülkiyet Talepleri  Hizmet, futbol müsabakalarına ilişkin olgusal spor bilgileri ve olasılıksal analitik çıktılar sunar. Şirket aşağıdaki hususları açıkça kabul ve beyan eder:    Resmi Bağlantı veya Onay Yoktur.  Şirket, Forge Zero ve Scorebuddy; FIFA, UEFA, CONMEBOL, CAF, AFC, CONCACAF, OFC, Türkiye Futbol Federasyonu (TFF), hiçbir ulusal futbol federasyonu, lig operatörü, kulüp, takım, oyuncu, teknik direktör, menajer, yayıncı, veri sağlayıcı veya başka bir üçüncü taraf hak sahibi ile   bağlantılı değildir , onaylanmamıştır, lisanslanmamıştır, sponsorluğu yapılmamıştır, yetkilendirilmemiştir veya başka bir şekilde ilişkilendirilmemiştir. Bu tür kuruluşlara yapılan herhangi bir atıf yalnızca olgusal, adsal ve tanımlayıcıdır.   Canlı Skor veya Gerçek Zamanlı Veri Yoktur.  Hizmet; canlı skorlar, gerçek zamanlı maç olayları, canlı yorum, canlı istatistikler, maç içi veriler veya herhangi bir canlı yayın içeriği   sunmaz , iletmez, görüntülemez veya yayınlamaz. Hizmete dahil edilen tüm maç skorları, yalnızca yaygın olarak erişilebilen kamu raporları aracılığıyla   genel kamu bilgisi haline geldikten sonra  kullanılır ve tescilli gerçek zamanlı veri teşkil edebilecekleri dönemde asla kullanılmaz.   Fikstürler ve Programlar.  Hizmet, Şirketin kamu menfaatine ilişkin olgusal bilgi olarak değerlendirdiği yaklaşan maç fikstürleri ve programları görüntüleyebilir. Şirket; 96/9/EC sayılı AB Direktifinin 7. maddesi veya eşdeğer   sui generis  veritabanı hakkı, Fikir ve Sanat Eserleri Kanunu (5846 sayılı FSEK) veya benzer herhangi bir yabancı yasa anlamında korunan bir veritabanının esaslı bölümlerini çoğaltmamakta ve söz konusu olgular üzerinde hiçbir mülkiyet iddia etmemektedir.   Takım ve Lig Adları.  Hizmette kulüplerin, liglerin, yarışmaların, federasyonların veya oyuncuların isimleri yer aldığında, bunlar yalnızca istatistiklerin, fikstürlerin ve analizlerin konusunu tanımlamak için   adsal, tanımlayıcı ve olgusal  amaçla kullanılır. Bu kullanım, adı geçen kuruluşla herhangi bir sponsorluk, onay, ortaklık, bağlantı veya lisans ilişkisini ima etmeyi amaçlamaz ve bu şekilde yorumlanmayacaktır.   Logo, Arma, Forma veya Resmi Grafikler Yoktur.  Hizmet; herhangi bir kulüp, lig, federasyon, yayıncı veya ilgili kuruluşun armaları, amblemleri, logoları, kelime markaları, maskotları, resmi formaları, fotoğraflarını, resimlerini, videolarını veya diğer tescilli ticari markalarını ya da korunan yaratıcı eserlerini çoğaltmaz, görüntülemez, dağıtmaz veya kullanmaz.   Oyuncu İstatistikleri ve Benzerlikler.  Hizmette atıfta bulunulan oyuncu istatistikleri kamuya açıklanmış maç verilerinden elde edilir ve yalnızca bilgilendirme, eğitim ve eğlence amacıyla kullanılır. Şirket; oyuncu fotoğraflarını, benzerliklerini, imaj haklarını, ad-imaj-benzerlik (NIL) haklarını veya kişilik haklarını çoğaltmaz ve hiçbir oyuncu tarafından onaylandığını iddia etmez veya ima etmez.   Çıktı Mülkiyeti.  Hizmet tarafından üretilen olasılıksal tahminler, analitik çıktılar ve türev istatistikler Şirketin tescilli modellerinin özgün iş ürünleridir ve herhangi bir üçüncü taraf korumalı içeriğin çoğaltmalarını teşkil etmez.   Fikri Mülkiyet Talep Prosedürü (Bildirim ve Kaldırma).  Şirket; diğerlerinin fikri mülkiyet haklarına saygı gösterir ve usulüne uygun şekilde belgelenmiş taleplere yanıt verir. Bir lig, kulüp, federasyon, yayıncı, yazar, acente veya başka bir meşru talep sahibi dahil bir hak sahibi iseniz ve Hizmetteki herhangi bir içeriğin telif hakkınızı, ticari markanızı, veritabanı hakkınızı, komşu hakkınızı, kişilik hakkınızı veya başka bir fikri mülkiyet hakkınızı ihlal ettiğini düşünüyorsanız, aşağıdakilerin tümünü içeren yazılı bir bildirim    support@forgezero.com  adresine gönderin:   Tam yasal adınız, posta adresiniz, telefon numaranız ve e-posta adresiniz (ve bir hak sahibi adına hareket ediyorsanız söz konusu hak sahibinin kimliği ve yetkinizin kanıtı);  İddia edilen ihlal edilen belirli hakkın açık bir tanımı; uygulanabilir olduğunda kayıt numaraları, yargı yetkisi ve ilgili mülkiyet veya kayıt belgelerinin kopyaları dahil;  İddia edilen ihlalci materyalin Şirketin konumlandırmasına yetecek şekilde Hizmet içindeki kesin tanımı (mümkünse ekran görüntüleri, zaman damgaları ve sürüm numaraları dahil);  Şikayet edilen şekildeki kullanımın hak sahibi, temsilcisi veya uygulanabilir hukuk tarafından yetkilendirilmediğine dair iyi niyetle yapılmış bir beyan;  Bildirimdeki bilginin doğru olduğuna ve hak sahibi adına hareket etme yetkisine sahip olduğunuza dair yanlış beyan cezası (veya yargı yetkinizdeki eşdeğeri) altında yapılmış bir beyan;  Fiziksel veya elektronik imzanız.  Şirket, iyi niyetle yapılmış ve eksiksiz bildirimleri değerlendirecek ve uygun olduğunda ABD Dijital Binyıl Telif Hakkı Yasası (\"  DMCA \"), 5651 sayılı Türk Kanunu, 5846 sayılı FSEK ve AB Dijital Tek Pazar Telif Hakkı Direktifi 2019/790 dahil uygulanabilir bildirim-ve-kaldırma çerçevelerine uygun olarak etkilenen içeriği hızla kaldırmak, devre dışı bırakmak veya değiştirmek için eylemde bulunacaktır. Şirket kendi takdirine bağlı olarak (a) eksik, hatalı veya kötü niyetli bildirimleri reddetme; (b) açıklama veya ek kanıt talep etme; (c) hukuken veya hukuki süreç gerektirdiğinde talep sahiplerinin kimliğini etkilenen taraflara açıklama; (d) karşı bildirimler sunma; ve (e) esaslı olarak yanlış veya istismarcı talep sunan kişilere karşı tazminat ve masraf talep etme hakkını saklı tutar. Fesih  İşbu Sözleşme feshedilinceye kadar yürürlüktedir. Şirket; işbu Sözleşmenin herhangi bir hükmünü ihlal etmeniz dahil, herhangi bir zamanda, gerekçeli veya gerekçesiz ve bildirimli veya bildirimsiz Hizmete erişiminizi askıya alabilir veya sona erdirebilir. Fesih üzerine, Hizmeti kullanma hakkınız derhal sona erecek ve 3 ile 14 arası ve 16 ile 23 arası Bölümler yürürlükte kalmaya devam edecektir.  16. Sözleşme Değişiklikleri  Şirket, işbu Sözleşmeyi istediği zaman değiştirme, değiştirme veya ekleme hakkını saklı tutar.    Esaslı Değişiklikler , yürürlüğe girmelerinden en az otuz (30) gün önce uygulama içi bildirim ve/veya forgezero.com aracılığıyla duyurulacaktır. Esaslı değişiklikleri kabul etmiyorsanız, değişiklikler yürürlüğe girmeden önce Hizmeti kullanmayı bırakmanız ve Uygulamayı kaldırmanız gerekir; değişikliklerin yürürlük tarihinden sonra devam eden kullanımınız kabulünüzü oluşturur.   Esaslı Olmayan Değişiklikler  (ör. yazım hataları, açıklamalar veya iletişim ayrıntısı güncellemeleri) revize edilmiş \"Yürürlük Tarihi\"nin yayınlanmasıyla derhal yürürlüğe girer.\nHer iki durumda da forgezero.com'da yayınlanan en son sürüm geçerlidir.  17. Mücbir Sebep  Hiçbir Korunan Taraf; doğal afetler, savaş, terör, sivil huzursuzluk, devlet eylemi, salgın, pandemi, internet veya telekomünikasyon arızaları ya da üçüncü taraf platform arızaları (Apple ve Google dahil) veya Yukarı Akış Kaynağı arızaları dahil makul kontrolü dışındaki olaylardan kaynaklanan herhangi bir ifa başarısızlığı veya gecikmesinden sorumlu olmayacaktır.  18. Bölünebilirlik  İşbu Sözleşmenin herhangi bir hükmü yetkili bir mahkeme tarafından geçersiz, hukuka aykırı veya uygulanamaz bulunursa, söz konusu hüküm onu geçerli ve uygulanabilir kılacak asgari ölçüde değiştirilecek veya değişiklik mümkün değilse, işbu Sözleşmeden ayrılacak ve kalan hükümler tam olarak yürürlükte kalmaya devam edecektir.  19. Feragatten Kaçınma  Şirketin işbu Sözleşme kapsamındaki herhangi bir hakkı kullanmakta gecikmesi veya kullanmaması bu haktan feragat teşkil etmeyecektir. No Personally Identifiable Information (\"PII\") on Our Servers:  Our backend infrastructure does not intentionally collect, log, retain, or correlate any PII of any User. Our databases contain no names, emails, phone numbers, device identifiers, geolocation, payment information, or behavioral profiles tied to any User. Any transient network-level data incidentally visible to our servers during ordinary request handling (such as IP addresses present in TCP/IP headers) is not logged, retained, or used to identify or profile Users.   No Telemetry or Analytics by Us:  We do not operate first-party telemetry, analytics, advertising SDKs, crash-reporting services, or tracking pixels that identify Users.   Local-Only Preferences:  Any settings, favourites, or preferences you configure are stored exclusively on your device and are never transmitted to us or any third party by the App.   Hosting-Provider Network Logs:  The Company operates the Service through third-party hosting and content-delivery infrastructure. These platforms independently collect certain data when you download, install, or use any mobile application, including ours, such as device identifiers, crash diagnostics, installation events, purchase history, and network information.   We do not control, receive, or have access to such platform-level data. Nature of the Service  Scorebuddy provides historical football statistics and outputs generated by algorithmic and probabilistic Machine Learning (\"  ML \") models. The Service is provided strictly for   informational, educational, and entertainment purposes only . The Service is   not  professional advice of any kind — financial, legal, investment, or otherwise — and must not be relied upon as such.  3. Subscriptions, Billing, and No-Refund Policy  Certain premium features of the Service may be offered on an auto-renewing subscription or one-time in-app purchase basis (collectively, \"  Paid Services \"). The following terms govern all Paid Services:    Platform Billing.  All transactions for Paid Services are processed   exclusively  by the app store platform through which you obtained the App — Apple App Store (via Apple Media Services) or Google Play Store (via Google Play Billing). The Company does not collect, process, store, or have access to your payment-card or banking information. Your billing relationship is exclusively with the relevant platform operator and is subject to that operator's payment terms, billing policies, and refund procedures.   Auto-Renewal.  Subscriptions automatically renew for successive periods of equal length at the then-current rate unless cancelled before the renewal date. You authorize Apple or Google, as applicable, to charge your payment method on each renewal.   Cancellation.  You may cancel any auto-renewing subscription at any time through your Apple ID account settings (for iOS users) or Google Play account settings (for Android users). Cancellations must be completed   at least twenty-four (24) hours  before the end of the current billing cycle to avoid being charged for the next period. The Company cannot cancel your subscription on your behalf.   Price Changes.  The Company may change the price of Paid Services at any time. Price changes applicable to your subscription will be communicated through the relevant platform and will take effect only for subsequent billing cycles, subject to any required notice and consent under applicable platform rules and consumer law.   No-Refund Policy.  To the maximum extent permitted by applicable law, all payments for Paid Services are   non-refundable . The Company will not provide refunds, credits, or prorated adjustments for: (i) partial subscription periods, (ii) unused features, (iii) dissatisfaction with any analytical output, (iv) the probabilistic failure, inaccuracy, or non-occurrence of any ML prediction (which is not a defect and is expressly disclaimed in Section 5), (v) Upstream Source failures (as defined in Section 6), (vi) your failure to cancel before a renewal, or (vii) any reason other than those required by mandatory consumer law.   Mandatory Consumer Rights.  Notwithstanding the foregoing, where applicable mandatory consumer-protection law grants you a non-excludable right to a refund or withdrawal — including without limitation the fourteen (14)-day right of withdrawal under the Turkish Distance Contracts Regulation (  Mesafeli Sözleşmeler Yönetmeliği ) pursuant to Consumer Protection Law No. 6502, and Articles 9–16 of EU Consumer Rights Directive 2011/83/EU — such rights shall apply to you to the extent required by law. You acknowledge, however, that   where you have expressly consented to the immediate supply of digital content before expiry of the withdrawal period and expressly acknowledged losing your right of withdrawal  (as permitted by those same laws and by Apple/Google platform terms), you thereby waive the withdrawal right with respect to that digital content to the fullest extent permitted by law.   Platform Refunds.  Refund requests may in all cases be directed to Apple (  https://support.apple.com/HT204084 ) or Google (  https://support.google.com/googleplay/answer/2479637 ) in accordance with their respective refund policies, which operate independently of this Agreement. Where Apple or Google issues a refund to you, the Company has no obligation to duplicate such refund.  4. Strict Prohibition on Betting, Wagering, and Gambling   Scorebuddy is not, and must not be used as, a sports-betting, gambling, lottery, wagering, chance-of-win, or financial-advisory tool.    Compliance with Turkish Law:  The Republic of Türkiye strictly regulates and/or prohibits unauthorized sports betting, wagering, and games of chance under (without limitation)   Law No. 7258  (  Futbol ve Diğer Spor Müsabakalarında Bahis ve Şans Oyunları Düzenlenmesi Hakkında Kanun ), the Turkish Criminal Code (Law No. 5237), and   Law No. 5651  (on the regulation of internet publications). Only authorized operators licensed by the competent Turkish authorities (  Spor Toto Teşkilat Başkanlığı  and   Türkiye Jokey Kulübü  within their respective scopes) may offer sports betting in Türkiye. The Service is not such a licensed operator and does not offer, facilitate, broker, or promote betting.   Classification as Misuse:  Any use of the statistics, outputs, insights, predictions, or any other content of the Service to place, inform, facilitate, broker, promote, or execute real-money or value-equivalent sports bets, wagers, or gambling of any kind is strictly prohibited and constitutes a   material breach  of this Agreement, irrespective of the legal status of such activity in the User's jurisdiction.   Assumption of Risk:  Sports outcomes are inherently unpredictable. You acknowledge and agree that you assume one hundred percent (100%) of all risk, cost, loss, and consequence for any decision or action you take on the basis of, or in connection with, the Service.   Compliance with Your Local Law:  You are solely responsible for ensuring that your use of the Service complies with all laws applicable to you, including without limitation any laws in your jurisdiction concerning sports statistics, prediction services, gambling, and data protection.  5. Machine Learning and \"As-Is\" Disclaimer  The statistical models and ML algorithms used by Scorebuddy are experimental, probabilistic, and non-deterministic.    No Guarantee of Accuracy:  The Company makes   zero  representations, warranties, or guarantees regarding the accuracy, completeness, reliability, timeliness, currency, or fitness of any output of the Service.   Disclaimer of All Warranties:  To the maximum extent permitted by applicable law, the Service, all content, and all outputs are provided on an \"  AS IS \" and \"  AS AVAILABLE \" basis, with   all faults  and   without warranty of any kind . The Protected Parties expressly disclaim all warranties, whether express, implied, statutory, or arising from course of dealing or usage of trade, including without limitation the implied warranties of merchantability, fitness for a particular purpose, accuracy, title, non-infringement, and quiet enjoyment.   No Advice:  Nothing in the Service constitutes professional, financial, legal, medical, or investment advice.  6. Service Availability and Upstream Data Reliance  The Service is built on top of continuous data feeds from independent third-party sports-data providers, public repositories, free and open-source software, and other upstream sources (collectively, \"  Upstream Sources \") that the Company does not own or control. You expressly acknowledge and agree that:    No Uptime Guarantee.  The Company makes no representation, warranty, or guarantee that the Service, any specific feature, or any analytical output will be available, uninterrupted, timely, secure, or error-free at any given time. The Service is provided on a reasonable-efforts basis only.   Upstream Volatility.  The Company shall not be liable for any degradation, delay, inaccuracy, suspension, limitation, or termination of the Service — or any part thereof — arising from the failure, change, outage, rate-limiting, access-revocation, price change, licensing change, reorganization, acquisition, shutdown, or any other act or omission of any Upstream Source or third-party platform (including Apple and Google). Upstream Sources are independent third parties, and their actions are outside the Company's reasonable control.   Right to Modify, Suspend, or Discontinue.  The Company reserves the right, at any time and in its sole discretion, to modify, suspend, limit, or discontinue the Service (or any feature, analytical output, league, competition, region, or integration) with or without notice, temporarily or permanently, and without liability to you or any third party. Where you have prepaid for Paid Services and the Company permanently discontinues the entire Service, the Company will cooperate with Apple or Google, as applicable, to facilitate pro-rata refunds to the extent required by applicable mandatory consumer law or platform policy.   Scheduled and Unscheduled Downtime.  The Service may be unavailable during maintenance, updates, or in response to security incidents. Such downtime shall not constitute a breach of this Agreement.  7. User Obligations  You shall not, and shall not permit any third party to:   Use the Service for any unlawful purpose or in violation of this Agreement;  Reverse engineer, decompile, disassemble, tamper with, or attempt to derive the source code, models, weights, or underlying algorithms of the Service, except to the extent such restriction is prohibited by applicable law;  Scrape, harvest, or mass-extract data from the Service;  Interfere with, disrupt, or attempt to gain unauthorized access to the Service or any related systems;  Use the Service in any manner that could damage, disable, overburden, or impair the Service;  Use the Service in connection with any betting, gambling, or wagering activity as further described in Section 4;   Automated Access and Output Harvesting.  Use any robot, spider, scraper, crawler, automated script, headless browser, AI agent, unauthorized application, or other automated or manual means to (i) access or use the Service other than through the ordinary user interface provided by the Company, (ii) extract, copy, aggregate, re-publish, monetize, or resell any predictive outputs, statistics, datasets, or model responses of the Service, or (iii) reconstruct, replicate, train, fine-tune, or distill any competing model, dataset, or service from the Service's outputs. Any violation of this provision is a   material breach  of this Agreement. In addition to any other remedy available at law or in equity, the Company reserves the right, in its sole discretion and without further notice, to immediately suspend or terminate your access to the Service and to permanently block the offending device, account, IP address, or other identifier.   Where the violating User is a natural-person consumer acting wholly outside the scope of any trade, business, craft, or commercial activity, the foregoing suspension and blocking shall be the Company's sole remedy under this bullet, and no prepaid fees shall be forfeited on the basis of this bullet.  Where the violating User is not such a consumer — including without limitation any person or entity acting for commercial, competitive, scraping, aggregation, model-training, distillation, or resale purposes — the Company additionally reserves the right to retain any prepaid fees as   liquidated damages , which the parties agree represent a reasonable pre-estimate of the damages suffered given the difficulty of quantifying output-theft harm. Where Turkish Code of Obligations Article 182 or any equivalent law empowers a competent court to reduce a penal or liquidated-damages clause deemed excessive, such reduction shall be the sole remedy, and the remainder of this Section shall remain in full force and effect.  8. Limitation of Liability  TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL ANY OF THE PROTECTED PARTIES BE LIABLE TO YOU OR ANY THIRD PARTY FOR ANY INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION:   Financial losses, lost profits, lost revenue, gambling losses, or debts incurred on any basis;  Loss of data, loss of use, loss of goodwill, or other intangible losses;  Any errors, mistakes, omissions, inaccuracies, or defects in content, outputs, or predictions;  Any unauthorized access to, or alteration of, your device or data;  Any third-party conduct or content on the Service.  The aggregate cumulative liability of the Protected Parties to you for all claims arising out of or relating to this Agreement or the Service shall not exceed the greater of (a) the total amount you have paid directly to the Company for the Service in the twelve (12) months preceding the event giving rise to the claim, or (b) twenty-five Turkish Lira (₺25).  This limitation applies whether the alleged liability is based on contract, tort (including negligence), strict liability, statute, or any other basis, and even if a Protected Party has been advised of the possibility of such damages.  Nothing in this Agreement shall exclude or limit the liability of any Protected Party for: (i) fraud or fraudulent misrepresentation; (ii) gross negligence or willful misconduct; (iii) death or personal injury caused by negligence; or (iv) any other liability that cannot be excluded or limited under applicable mandatory law (including Turkish Consumer Protection Law No. 6502 and the EU Unfair Contract Terms Directive 93/13/EEC). This Section shall be interpreted to provide the Protected Parties with the maximum protection permissible under applicable law.  9. Indemnification  To the maximum extent permitted by applicable law, you agree to defend, indemnify, and hold harmless the Protected Parties from and against any and all claims, actions, demands, damages, judgments, liabilities, losses, costs, and expenses (including reasonable attorneys' fees and court costs) arising from or relating to:   Your use of, or access to, the Service;  Your breach of any term or representation of this Agreement, including without limitation the prohibition on betting and wagering in Section 4;  Your violation of any applicable law or any right of any third party.  This Section shall apply only to the extent permitted by mandatory consumer-protection law in your jurisdiction; where applicable mandatory consumer law limits indemnification by consumers, this Section shall apply only to the extent so permitted, and the remainder of this Agreement shall remain in full force and effect.  10. Governing Law and Jurisdiction  This Agreement shall be governed by, and construed in accordance with, the laws of the   Republic of Türkiye , without regard to its conflict-of-laws provisions. The United Nations Convention on Contracts for the International Sale of Goods does not apply.  Any dispute, controversy, or claim arising out of or relating to this Agreement or the Service shall be brought exclusively in the competent courts and enforcement offices of   Büyükçekmece, Istanbul, Türkiye , and the parties hereby irrevocably submit to the personal jurisdiction and venue therein.  Notwithstanding the foregoing, where you are a consumer resident in Türkiye, the European Union, the United Kingdom, or another jurisdiction whose mandatory consumer-protection law grants you the right to bring proceedings in your local courts or the benefit of mandatory local protections, such rights shall continue to apply to you and nothing in this Agreement shall be construed to deprive you of them. Turkish consumer disputes within applicable monetary thresholds may, where required by law, be brought before the competent   Tüketici Hakem Heyeti  or   Tüketici Mahkemesi .  11. Apple App Store EULA Provisions  If you accessed or downloaded the App from the Apple App Store, the following additional terms apply, as required by Apple Inc. (\"Apple\"):    Acknowledgement.  This Agreement is concluded between you and the Company only, and not with Apple. The Company (not Apple) is solely responsible for the App and its content.   Scope of License.  The license granted to you for the App is limited to a non-transferable license to use the App on any Apple-branded product that you own or control, as permitted by Apple's Usage Rules set forth in the Apple Media Services Terms and Conditions.   Maintenance and Support.  The Company is solely responsible for any maintenance and support services with respect to the App. Apple has no obligation whatsoever to furnish any maintenance or support services with respect to the App.   Warranty.  To the extent permitted by applicable mandatory consumer law — including the statutory rights of consumers in the European Economic Area and the United Kingdom that cannot be excluded by agreement — the Company is solely responsible for any product warranties, whether express or implied by law, to the extent not effectively disclaimed. In the event of any failure of the App to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any) for the App; to the maximum extent permitted by applicable law, Apple has no other warranty obligation whatsoever with respect to the App, and any other claims, losses, liabilities, damages, costs, or expenses attributable to any failure to conform to any warranty are the sole responsibility of the Company.   Product Claims.  The Company, not Apple, is responsible for addressing any claims relating to the App or your use of it, including (i) product-liability claims, (ii) any claim that the App fails to conform to any applicable legal or regulatory requirement, and (iii) claims arising under consumer-protection, privacy, or similar legislation.   Intellectual Property Rights.  In the event of any third-party claim that the App or your possession or use of the App infringes that third party's intellectual property rights, the Company (not Apple) will be solely responsible for the investigation, defense, settlement, and discharge of any such infringement claim.   Legal Compliance.  You represent and warrant that (i) you are not located in a country subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a \"terrorist supporting\" country; and (ii) you are not listed on any U.S. Government list of prohibited or restricted parties.   Third-Party Beneficiary.  You and the Company acknowledge and agree that Apple and Apple's subsidiaries are third-party beneficiaries of this Agreement, and that upon your acceptance of this Agreement, Apple will have the right (and will be deemed to have accepted the right) to enforce this Agreement against you as a third-party beneficiary thereof.  12. Google Play Store Provisions  If you accessed or downloaded the App from Google Play, you acknowledge that your use of the App is also subject to the Google Play Terms of Service, and that Google LLC (\"Google\") and its affiliates are third-party beneficiaries of this Agreement and may enforce it against you. The Company is solely responsible for the App and its content; Google is not. Platform-level data practices of Google are governed by Google's own privacy policy as described in Part I, Section 3.  13. Intellectual Property  All rights, title, and interest in and to the Service, including all content, software, models, algorithms, trademarks, logos, and associated intellectual property, are and shall remain the exclusive property of the Company and its licensors. Except for the limited, personal, revocable, non-exclusive, non-transferable license to use the App on a device you own or control for your personal, non-commercial use, no rights are granted to you under this Agreement.  14. Third-Party Sports Data, Marks, and Intellectual Property Claims  The Service provides factual sports information and probabilistic analytical outputs relating to football (soccer) competitions. The Company expressly acknowledges and affirms the following:    No Official Affiliation or Endorsement.  The Company, Forge Zero, and Scorebuddy are   not  affiliated with, endorsed by, licensed by, sponsored by, authorized by, or otherwise associated with FIFA, UEFA, CONMEBOL, CAF, AFC, CONCACAF, OFC, the Türkiye Futbol Federasyonu (TFF), any national football federation, any league operator, any club, any team, any player, any coach, any agent, any broadcaster, any data provider, or any other third-party rights holder. Any reference to such entities is purely factual, nominative, and descriptive.   No Live Scores or Real-Time Data.  The Service   does not  provide, transmit, display, or broadcast live scores, real-time match events, live commentary, live statistics, in-play data, or any live broadcast content of any kind. All match scores incorporated into the Service are used   only after they have become a matter of general public knowledge  through widely available public reporting, and never during the period in which they may constitute proprietary real-time data.   Fixtures and Schedules.  The Service may display upcoming match fixtures and schedules, which the Company treats as factual information of public interest. The Company does not reproduce substantial portions of any protected database within the meaning of Article 7 of EU Directive 96/9/EC or any equivalent   sui generis  database right, Turkish Law No. 5846 on Intellectual and Artistic Works (  Fikir ve Sanat Eserleri Kanunu ), or any comparable foreign statute, and claims no ownership over such facts.   Team and League Names.  Where the names of clubs, leagues, competitions, federations, or players appear in the Service, they are used solely in a   nominative, descriptive, and factual  capacity to identify the subject matter of statistics, fixtures, and analyses. Such use is not intended to suggest, and shall not be construed as suggesting, any sponsorship, endorsement, partnership, affiliation, or licensing relationship with the named entity.   No Logos, Badges, Kits, or Official Artwork.  The Service   does not  reproduce, display, distribute, or otherwise use the crests, badges, logos, wordmarks, mascots, official kits, photographs, artwork, videos, or any other registered trademarks or protected creative works of any club, league, federation, broadcaster, or related organization.   Player Statistics and Likenesses.  Any player statistics referenced in the Service are derived from publicly reported match data and are used strictly for informational, educational, and entertainment purposes. The Company does not reproduce player photographs, likenesses, image rights, name-image-likeness (NIL) rights, or personality rights, and asserts no endorsement by any player.   Output Ownership.  Probabilistic predictions, analytical outputs, and derivative statistics produced by the Service are the original work product of the Company's proprietary models and do not constitute reproductions of any third-party protected content.   Intellectual Property Claim Procedure (Notice and Takedown).  The Company respects the intellectual property rights of others and responds to properly substantiated claims. If you are a rights holder — including a league, club, federation, broadcaster, author, agent, or any other lawful claimant — and you believe that any content within the Service infringes your copyright, trademark, database right, neighbouring right, right of publicity, or any other intellectual property right, please send a written notice to    support@forgezero.com  containing all of the following:   Your full legal name, postal address, telephone number, and email address (and, if you are acting on behalf of a rights holder, the identity of that rights holder and evidence of your authority to act);  A clear identification of the specific right allegedly infringed, including registration numbers, jurisdiction, and copies of relevant title or registration documents where applicable;  A precise identification of the allegedly infringing material within the Service sufficient to enable the Company to locate it (including screenshots, timestamps, and version numbers where possible);  A statement, made in good faith, that the use of the material in the manner complained of is not authorized by the rights holder, its agent, or applicable law;  A statement, under penalty of perjury (or its equivalent under your jurisdiction's law), that the information in the notice is accurate and that you are authorized to act on behalf of the rights holder;  Your physical or electronic signature.  The Company will evaluate each good-faith, complete notice and, where appropriate, act expeditiously to remove, disable, or modify the affected content, consistent with applicable notice-and-takedown frameworks including the U.S. Digital Millennium Copyright Act (\"  DMCA \"), Turkish Law No. 5651 (on the regulation of publications on the internet), Turkish Law No. 5846, and the EU Copyright in the Digital Single Market Directive 2019/790. The Company reserves the right, in its sole discretion, to: (a) reject incomplete, defective, or bad-faith notices; (b) request clarification or additional evidence; (c) disclose the identity of claimants to affected parties where required by law or legal process; (d) submit counter-notices; and (e) seek damages and costs against persons who submit materially false or abusive claims.   Nothing in this Section constitutes a waiver of any defense , including fair use, fair dealing, nominative fair use, factual-information exemptions, freedom of expression, or any statutory limitation or exception under applicable law.  Rights holders agree, to the fullest extent permitted by applicable law, to use the foregoing procedure in good faith as the   primary first-step channel  for asserting intellectual property claims against the Company with respect to the Service, before initiating any formal legal proceeding. Nothing in this paragraph shall be construed as waiving, restricting, or otherwise limiting any rights holder's right of access to a court of competent jurisdiction.  15. Termination  This Agreement is effective until terminated. The Company may suspend or terminate your access to the Service at any time, with or without cause and with or without notice, including if you breach any provision of this Agreement. Upon termination, your right to use the Service will immediately cease, and Sections 3 through 14 and 16 through 23 will survive.  16. Amendments to the Agreement  The Company reserves the right to modify, replace, or supplement this Agreement at any time.    Material Changes  will be announced through an in-App notification and/or on forgezero.com at least thirty (30) days before they take effect. If you do not agree to the material changes, you must stop using the Service and uninstall the App before the changes take effect; your continued use after the effective date of the changes constitutes your acceptance.   Non-Material Changes  (such as typographical corrections, clarifications, or updates to contact details) take effect immediately upon the revised \"Effective Date\" being posted.\nIn either case, the most recent version posted on forgezero.com governs.  17. Force Majeure  No Protected Party shall be liable for any failure or delay in performance caused by events beyond its reasonable control, including without limitation acts of God, natural disasters, war, terrorism, civil unrest, government action, epidemics, pandemics, internet or telecommunications failures, or failures of third-party platforms (including Apple and Google) or Upstream Sources.  18. Severability  If any provision of this Agreement is held to be invalid, illegal, or unenforceable by a court of competent jurisdiction, that provision shall be modified to the minimum extent necessary to make it valid and enforceable, or if modification is not possible, severed from this Agreement, and the remaining provisions shall continue in full force and effect.  19. No Waiver  No failure or delay by the Company in exercising any right under this Agreement shall operate as a waiver of that right. Any waiver must be in writing and signed by an authorized representative of the Company.  20. Assignment  You may not assign or transfer this Agreement or any rights hereunder without the prior written consent of the Company. The Company may assign this Agreement at any time without notice to you. Any purported assignment in violation of this Section is void.  21. Entire Agreement  This Agreement, together with any terms incorporated by reference herein, constitutes the entire agreement between you and the Company concerning the Service and supersedes all prior or contemporaneous agreements, proposals, or communications, whether oral or written.  22. Language  This Agreement is drafted in English. A Turkish translation may be provided for convenience at forgezero.com. In the event of any conflict or inconsistency between the English and Turkish versions, the   English version shall prevail , except where Turkish law mandates the primacy of the Turkish text for Turkish consumers, in which case the Turkish text shall prevail to that extent only.  23.
